Westpac Banking Corporation recently undertook a review of its long service leave arrangements and determined that it contravened the Fair Work Act 2009 (Cth) by not properly applying the long service leave provisions for a number of current and former employees.
 

In April 2020, Westpac reported to the Fair Work Ombudsman (FWO) that it had not properly accrued or paid long service leave entitlements to all its employees.
 

Westpac apologises sincerely that this error has occurred. In 2020, Westpac wrote to current and former employees that it could locate who were impacted to inform them of the issue and apologise. Since then, Westpac has repaid all long service leave underpayments to the current and former employees that it could locate with interest.
 

Westpac has now entered into an Enforceable Undertaking with the FWO to ensure its ongoing compliance with its long service leave obligations under Commonwealth workplace laws.
 

Westpac has, as a result of the Enforceable Undertaking, committed to undertaking a number of activities to ensure its ongoing compliance, such as conducting independent audits.
